Thank you for choosing Website For Creatives. These Terms of Service (“Terms”) govern your use of our services and website. By purchasing services or using our website, you agree to these Terms.
We’ve written these in plain language because we believe in transparency and respect for your time. If you have questions about anything here, please reach out—we’re happy to clarify.
1. Services Overview
Website For Creatives provides three main services:
Custom Website Development: Full-service website design and development projects with custom quotes based on scope.
Web Care: Time-based technical support purchased in blocks (Quick Task: 1 hour, Half Day: 4 hours, Full Day: 8 hours).
DIY Consulting: One-on-one coaching sessions for website guidance and technical problem-solving.
2. Custom Website Development
2.1 Quotes and Proposals
- Custom quotes are provided based on your specific project requirements
- Quotes are valid for 30 days from the date provided
- Project scope is defined in a separate project agreement before work begins
2.2 Payment Terms
- 50% deposit required to begin work
- Final 50% payment due upon project completion
Payments accepted via Square - Late payments may result in suspension of work
2.3 Project Timeline
- Timeline estimates are provided in good faith but are not guarantees
- Timelines may be affected by client response time, content delivery, and scope changes
- Client delays of more than 14 days may result in project re-scheduling
2.4 Client Responsibilities
You agree to:
- Provide timely feedback and approvals
- Supply content, images, and materials as agreed
- Provide website access credentials when needed
- Review and test the website before final approval
- Communicate changes or concerns promptly
2.5 Revisions
- Number of revision rounds specified in project agreement
- Additional revisions beyond agreed scope billed at hourly rate of $75/hour
- Revision requests must be consolidated and submitted together
2.6 Launch and Post-Launch Support
- 30 days of post-launch support included for bug fixes related to original scope
- Support does not include new features, content changes, or issues caused by client modifications
- After 30 days, support available through Web Care or consulting sessions
2.7 Ownership and Rights
- Upon full payment, you own the completed website and its content
- You own all content you provide (text, images, logos, etc.)
- You receive license to use third-party components (themes, plugins) per their terms
- Website For Creatives retains right to showcase project in portfolio unless otherwise agreed
3. Web Care
3.1 How It Works
- Purchase time blocks online: Quick Task (1 hour – $55), Half Day (4 hours – $200), or Full Day (8 hours – $375)
- Submit task list after purchase
- Work begins no earlier than 2 business days of receiving access credentials and task list
3.2 Time Usage
- Time billed in 15-minute increments
- Includes actual work time plus testing and documentation
- Does not include time waiting for client responses or access
- Unused time does not roll over or transfer
3.3 Task Scope
Web Care can be used for:
- Bug fixes and troubleshooting
- Content updates
- Feature additions
- Maintenance tasks
- Technical support
Web Care cannot be used for:
- Full website redesigns (use Custom Website Development)
- Projects requiring extensive discovery or planning
- Ongoing monthly retainer work (contact us for custom arrangement)
3.4 Access Requirements
- You must provide necessary website access credentials
- Work cannot begin without proper access
- You are responsible for backing up your website before we begin work
- We are not responsible for issues caused by inadequate access or incorrect credentials
3.5 Completion and Time Tracking
- You’ll receive progress updates during work
- Final summary includes detailed time breakdown
- If tasks exceed purchased time, we’ll notify you before proceeding
- Additional time can be purchased to complete remaining tasks
3.6 Refunds
- No refunds once work has begun
- If we cannot complete your tasks due to technical limitations, unused time will be refunded
- Refunds issued to original payment method within 7-10 business days
4. DIY Consulting
4.1 Session Structure
- First 30-minute session is free (discovery call)
- Additional sessions: $45 per 30 minutes
- Sessions conducted via video call or phone
4.2 Booking and Payment
- Book sessions through online scheduling system
- Prepayment required for all sessions except initial discovery call
- 24-hour cancellation notice required for refund or rescheduling
4.3 Scope of Consulting
Consulting includes:
- Strategy advice and recommendations
- Technical guidance and problem-solving
- Platform recommendations
- Best practices and workflow optimization
Consulting does not include:
- Hands-on technical work (use Web Care)
- Unlimited follow-up support
- Guarantees that your implementation will work
4.4 Your Responsibility
- You are responsible for implementing recommendations
- We provide guidance, not guarantees of specific outcomes
- You’re encouraged to take notes during sessions
- No recordings without prior permission
5. General Terms for All Services
5.1 Communication
- Primary communication via email: websiteforcreatives@gmail.com
- Response time: Within 2 business days
- Emergency support not available; contact if urgent needs arise
5.2 Confidentiality
- We treat your business information, access credentials, and project details as confidential
- We will not share your information with third parties except as necessary to provide services
- You grant us permission to access your website and accounts as needed to complete work
5.3 Third-Party Services
- Many websites use third-party platforms, plugins, themes, or services
- You are responsible for any fees charged by third-party providers
- We are not responsible for third-party service outages, changes, or discontinuation
- Third-party services are subject to their own terms and conditions
5.4 Backups
- You are responsible for maintaining your own website backups
- We recommend automated backup solutions
- We are not responsible for data loss, though we take reasonable precautions
5.5 Website Security
- We follow security best practices
- You are responsible for maintaining secure passwords
- You should update your website platform, plugins, and themes regularly
- We are not responsible for security breaches caused by weak passwords, outdated software, or third-party vulnerabilities
5.6 Browser and Device Compatibility
- Websites tested on modern browsers (Chrome, Firefox, Safari, Edge – current versions)
- Websites designed to be responsive on mobile devices
- We cannot guarantee perfect display on all browsers, devices, or screen sizes
- Legacy browser support (IE, old mobile devices) may require additional work
5.7 Performance and Uptime
- Website performance depends on many factors including hosting, traffic, and content
- We optimize for performance but cannot guarantee specific load times
- We are not responsible for hosting downtime or service interruptions
6. Limitation of Liability
6.1 Service Provided “As Is”
- Services provided “as is” without warranties of any kind
- We do not guarantee that websites will be error-free or uninterrupted
- We do not guarantee specific business results or outcomes
6.2 Liability Cap
- Our total liability for any claim related to our services is limited to the amount you paid for those specific services
- We are not liable for indirect, incidental, consequential, or special damages
- This includes but is not limited to: lost profits, lost data, business interruption, or loss of business opportunity
6.3 Your Responsibility
You are responsible for:
- Content legality and ownership rights
- Compliance with applicable laws and regulations
- Your use of your website and any resulting consequences
- Backing up your data and website
7. Intellectual Property
7.1 Your Content
- You retain all rights to content you provide (text, images, logos, videos, etc.)
- You grant us license to use your content to provide services
- You warrant that you have rights to all content you provide
7.2 Third-Party Components
- Websites may include themes, plugins, fonts, images, or code from third parties
- These components are licensed to you per their respective terms
- You are responsible for complying with third-party licenses
7.3 Our Work
- Custom code and design work becomes yours upon full payment
- We retain the right to use general techniques, processes, and knowledge gained
- We may showcase your project in our portfolio unless you request otherwise
8. Termination
8.1 By You
- Custom projects: You may terminate with written notice; refunds per project agreement
- Web Care: No refunds once work has begun
- Consulting: Cancel with 24-hour notice for refund
8.2 By Us
We may terminate services if:
- You fail to make required payments
- You breach these Terms
- You behave abusively or disrespectfully
- Continuing service is not feasible for technical or legal reasons
8.3 Effect of Termination
- You remain responsible for payment for work completed
- We will provide you with work completed to date (if applicable)
- Any ongoing services or access will cease
9. Changes to Terms
- We may update these Terms occasionally
- Changes effective upon posting to our website
- Your continued use of services constitutes acceptance
- Significant changes will be communicated via email
10. Dispute Resolution
10.1 Good Faith Resolution
